Notice of Seizure and Forfeiture
WHEREAS, on the 31st day of March, 2008, the United States Attorney for the Middle District of Georgia filed a Verified Complaint for Forfeiture in Civil Action No. 5:08-CV-96-HL in the United States District Court for the Middle District of Georgia against: $12,700.00 in United States funds (hereinafter referred to as "defendant property"), seized from Wesley Lamar Tuff, Jr. on September 8, 2007 in Lamar County, Georgia, in a cause of action alleging forfeiture pursuant to 21 U.S.C. § 881(a)(6); and
WHEREAS, by virtue of process in due form of law to me directed, I, Theresa A. Rodgers, United States Marshal, have arrested defendant property and have same under my custody;
THEREFORE, notice is hereby given to all persons claiming any right to or interest in the defendant property, to file a verified claim with the Clerk of this Court within thirty (30) days after May 20, 2008, or within such additional time as may be allowed by the Court. The claim must be verified on oath and must state the interest in the property by virtue of which the claimant asserts the right to defend this action. If the claim is made by an agent, bailee, or attorney on behalf of the person entitled to possession of the property, it shall state the authority by which he/she is entitled to make the claim on behalf of such person.
Any person filing a claim must also file an answer to the complaint within twenty (20) days after the filing of the claim.
The claim and answer should be filed with the Office of the Clerk, United States District Court, Middle District of Georgia, 475 Mulberry Street, Macon, Georgia 31202, with a copy thereof sent to Donald L.
