Barring public outcry, former Milner restaurateur and paving contractor Rudy Vaughn will be released from prison on parole September 14.
Vaughn pleaded guilty to three counts of theft by receiving stolen property on April 19, 2007 and was sentenced to 10 years in prison. If released as scheduled, he will have served just under 25% of his sentence.
As part of a plea deal, Vaughn also gave the county his restaurant, Rudy's House of BBQ in Milner, and forfeited $100,000.
Vaughn had a lengthy criminal history including weapons convictions and faced 23 counts of possession of a firearm by a convicted felon if his case had gone to trial. He gave up his firearms and those charges were dropped.
Vaughn was implicated in a multi-state cargo theft ring but avoided trial on the vast majority of the charges filed against him.
While on parole, Vaughn will live with his girlfriend Peggy Dorsett at 330 Old Alabama Road in Milner. Dorsett was a codefendant of Vaughn's in the case but charges against her were dropped as part of the plea deal.

Questions:
Were Vaughn and Dorsett treated differently than other criminals facing similar long terms in the penitentiary?
Did they bargain such a sweet plea because they had cash and a faltering business to forfeit to Lamar County?
What was the source of the $100,000 cash?
Should it not have been seized as part of the defendants' continuing criminal enterprise?
The 21.59 acres owned by Vaughn and Dorsett at 330 Old Alabama Road is presently valued by the LC Assessors office at $534,501!

Why was the bulk of their assets left intact and not TOTALLY seized?
Under Georgia Code 16-11-131 (b) Vaughn could have been sentenced to 5 years in prison if convicted on a single count of felon in possession of a gun charge. He had 23 counts against him!
There were and still are many valuable assets that could have possibly forfeited by the defendants. Are there other valuable assets not discovered or overlooked by the system?
Who profited from Vaughn's receiving such a "slap on the wrist"?
The citizens of Lamar County was short-changed!

Possibly they didn't get the big dog he thought he did, and also didn't want other stuff to get out like it would in a jury trial.
Possibly BBQ man would have walked if it went to trial and all the evidence (and lack therof) was presented. Who knows. but again, sling enough $h!t at someone, and some will stick.
I think the plea bargian probably saved the county some embarrassment.

Your weak lament may bring hope to you, but alas, HOPELESS is closer in being the correct verbiage due to Vaughn's prior criminal acts and subsequent proof that he "didn't learn his lesson" very well. Short prison sentences make for inadequate teaching of lessons to be learned.
As you will read, Vaughn was convicted of very serious charges in 1988 and was incarcerated for about 20 months. It appears Vaughn "flew below the radar" for almost 20 years while amassing a fortune in assets. With two such shallow sentences, do YOU think Vaughn has "learned his lesson..."? I think not.

My thought on that subject would be:
'people who have committed LESSER crimes do MORE time'....BECAUSE they did not have the resources to make platinum plea bargains. These LESSER-MORE defendants were forced to take any plea deal without dictating terms.

I know plea deals save the prosecutor time (he gets paid the same if he goes to trial or not) but plea deals suck for public safety.

Did Vaughn violate the RICO Act?
Was a Criminal Conspiracy present?
Were any real estate assets and business ventures financed with unreported income?
Was rental income reported?
Were bank accounts investigated?
Was a paper trail followed to discover details regarding Vaughn properties?
Were the seized weapons legally purchased?
Who purchased them for Vaughn? He is a Felon.

Were these weapons destroyed?

Vaughn is far from being a poor ex-convict who must stay in a half-way house when he is released. He doesn't have to consider being an "ordinary" poor Black ex-con worrying about his next meal and if he can find a job. No suh!

I feel the embarassment to Lamar County is the plea Bargain.
