This ruling seems questionable. It seems that the judge is saying that the "Office" of the Sheriff's Department bears no responsibility simply because an election took place and replaced the old sheriff. With that kind of philosophy it would appear that an argument could be made that any unfinished criminal proceedings are no longer enforceable simply because the "Office" of the Sheriff has changed hands rendering all actions of the past administration moot.
I guess another lawsuit will now be filed against buice. While I don't agree with Vaughn having his personal property unlawfully taken without due process, you can't blame Waller for it, he wasn't even there.
Two wrongs don't make a right. He went through the system, did what he was supposed to do, gave up a LOT of property he owned before the crimes were even committed, and buice STILL hit him when he was down. And Vaughn is now trying to get on with his life and be a productive citizen. Thats a lot more than a lot of folks who have never been in trouble do.
I can't believe buice is so arrogant to think he will waltz right back in office in a couple of years.
Two different things.
There were law suits pending at one time. In fact a while back someone listed them on this site. I dont know what came of them. So if Rudy goes after the county and Buice, Im sure he has a case, no matter what or how we feel about him. What will come of the guy with the flash bang strapped to his neck...is he sueing? There were certanily enough wittnesses.Oh well, time will tell.
Vaughan is just a little more vocal than others.
I sure hope this isn't the end of it, and knowing Vaughan, it won't be.

One question though...can the GBI tie wallers hands or can he go ahead an present the evidence to Milam?
They can take it to the grand jury and to pre-trial and dismiss the charges and we will all be back where we are now. The acquittal excuse doesn't fly here because there are so many options.
Of course, Becky could always sue for wrongful death and all of the evidence would come out in civil court and she would only need a preponderance of the evidence and not beyond a reasonable doubt. It would not have to be an unanimous verdict either.

Just because you're "the damn sheriff" doesn't mean you can take stuff during a search warrant and keep it. Well, not legally anyway.
Ethics and honesty were never a strong points of the previous administration.
