Investigators from the Georgia Bureau of Investigation and the Lamar sheriff’s office continue to investigate the now 26-year-old mystery of the murder of Donna Ogletree Johnson.

A writ of mandamus or mandamus (which means "we command" in Latin), or sometimes mandate, is the name of one of the prerogative writs in the common law, and is "issued by a superior court to compel a lower court or a government officer to perform mandatory or purely ministerial duties correctly".[1]
Mandamus is a judicial remedy which is in the form of an order from a superior court to any government subordinate court, corporation or public authority to do or forbear from doing some specific act which that body is obliged under law to do or refrain from doing, as the case may be, and which is in the nature of public duty and in certain cases of a statutory duty.[2] It cannot be issued to compel an authority to do something against statutory provision.
Mandamus may be a command to do an administrative action or not to take a particular action, and it is supplemented by legal rights. In the American legal system it must be a judicially enforceable and legally protected right before one suffering a grievance can ask for a mandamus. A person can be said to be aggrieved only when he is denied a legal right by someone who has a legal duty to do something and abstains from doing it.

Why don't you run for District Attorney? Even if you were totally confused in the job and failed to get anyone to trial we still wouldn't be any worse off than we are now.
Walter is to be commended for not letting this be forgotten. Until the murderer(s) is/are caught, the community is not safe.
The public can do a lot by helping to put pressure on law inforcement and the DA to make this a top priority. Every time you see the sherriff or the DA- on the street, in a restaurant, at the courthouse- ask about Donna. Ask whether they've made any new advancements. Tell them that catching the killer is important to you.
Everytime you see the suspects, ask them how the case is going. Ask if they're excited about authorities getting closer to catching the person who did this. Ask them, "Won't you be happy to get closure after so many years?"
Can you imagine the pressure of having to answer these questions over and over and over again, by so many different people, every single day? The sherriff and the DA will get the message loud and clear that the voters demand this be resolved. The perpitrator(s) and his/their accomplice(s) will get the message that it's not going away and they can never, ever rest easy again.

I always wondered what kind of depraved rage would drive somebody to gouge a woman's eyes out, sodomize her with a metal object, beat her head in with a hammer and run over her with a car. If a man thought his wife was in love with another man, that would probably make him pretty angry. Could that be a motive?
I'm still puzzled why her father-in-law , if in fact, he saw her or talked to her at 2:15, would be so worried about her not returning from the dump less than two hours later. (Mike found her car at the dumspter at 4:20.) You wouldn't normally start worring that soon without some reason to do so. I still find that VERY odd.
Also, I believe Mike was a little older than 17 at the time of the crime. I'm pretty sure Mike graduated in 1983, so he would have been at least 18 at the time and I'm thinking he was closer to 19. Not that it matters, but he was legally an adult at the time.
I am too old and broke down now. In my younger days, I would have been murdered because honesty and telling voting taxpayers the truth will get you killed. And believe me I WOULD HAVE THEN and STILL WOULD TODAY. As long as I was allowed to be alive......by the thieving, greedy crooks that would have then and still would surround me today. But I thank you for your vote of confidence.
You, nor a newspaper, have the privelidge of issuing this "Writ of mandamus" as previously suggested.
That is not your choice, thats the way it is, just like it's not your "choice" not to be involved past "observer" or "speculator" or however you wish to phrase it. Want real involvement? Hire a private investigator to research this. But no, you'd rather ramble on and on for attention, instead of putting your money where your mouth is.
Also, this case certianally derseves recognition and support, but there are sure a lot of others in the local area that were just as bad that are unsolved that do too, why aren't y'all crying about those too?
Deputy buice wasn't the only one to do anything with this recently. It says above that in '95 they were interviewing people, yet, as usual, the newspaper articles are dripping with such unbiased, loving support for him. How surprising.
I've never met the man- don't know a thing about him. If, however, he went to the lenghths reported here to bring justice for a family who's daughter was murdered so long ago and to send a BRUTAL KILLER to jail, so his county can be a safer place- at least in this instance, the man did his job well.
I don't care if Santa Claus brings a conviction wrapped with a bright red bow, the family deserves it, the community should demand it.
Somebody looked into her face and gouged her eyes out, then bashed her head in with a hammer. He sodomized her with a foreign object. He looked at her, touched her, heard her scream and plead for her life. He heard her take her last breath. He did this with his hands. He must have been covered in her blood. Finally, he ran over her. Then, he went on about his life, as if nothing ever happened for 26 years.
It'd be awful if Donna's killer was a stranger, but how much more heinous if she knew him- a neighbor, a friend, a family member? Is this county okay with having somebody who would do this walking free?

"Not Sheila" posted a definition of "writ of mandamus". No where in her post did she state or imply that she or the newspaper has the priviledge to issue one.

The people of Lamar County shouldn't have to hire a private investigator to do what the legal system is paid to do. Citizens already pay dearly for it with their taxes.
Donna's family deserves justice and the public deserves to be protected from a brutal murderer.
A basic question for everyone blaming Milam and the current administrations; Just how is something that happened almost 30 years ago suddenly Milams or the current Sheriffs responsibility to lay all current business aside and start over (again) on? Milam and Waller inherited an apparently shoddily put together case from several previous administrations, from DA's to former sheriffs to even GBI agents. None of the other officials presented it to a grand jury either, and folks weren't all up in arms over it, but now all of a sudden, since it is getting newspaper coverage, some think Milam is the one to blame. Seems there is plenty to go around rather than to just blame him and Waller, but then again, common sense isn't very prevelant here, so flame on.
The basic answer for you is this. Did they run for the job? If they did, then Hip-Hip Hooray. They got it. No one drafted these people into their jobs. They put on their Big Boy Boxers and campaigned for the job. Because they wanted it. This is NOT ONE THING to do with past elected officials. It started with a wonderful obituary written about Miss Beulah, then everyone wants to talk about the case was still open......so is the damn Mexican Border. We want them closed! Not wanting to lay anything on Waller but Milam put together his own reputation. His past speaks for itself. It is easy to do a job when you never have to do the job.

There is nothing wrong with the citizens re-energizing the investigation. I would think the only people who would be bothered by that are the ones with something to lose. Whatever that something might be.
If he did that, it sounds like maybe he couldn't preform sexually. People in the 80's didn't know about DNA or bugs!

Remember, there are many, many more officials to blame for a supposedly botched investigation than the current Sheriff and DA. But it is so much easier for those of lower intelligence to simply blame whoever is currently in office, without considering the fact that they merely inherited a cold, old case. I know you get your emotions all wound up over this, and that is understandable, but it still doesn't change the facts of, or the lack of facts, in the case.

Everyone knows what their job is, and that they have it. And we do not have to be "one of them" or "follow orders" to get on here and oppose you in support of our elected officials, including the current Sheriff and district attorney. And Tolley, you are way too arrogent for your own good, and apparently have no good reason to be. this wasn't the act of a stranger....this was personal...very personal alot of rage and evil from someone who knew her well...that had motive and opportunity she was dead well before 8 a.m. --- she was brutally beaten and it took awhile for that kind of beating--who had opportunity? where would she be early in the morning...or late at night? why would a father say he saw her at 2 p.m., when she was dead way earlier than that? how far would some parents go to protect their children?

I'll answer your first grade question for you. They do not get paid to lay anything down, taxpayers want everything done. If they had to pick this one up...evidently it was not "OPEN" as was stated in their comments in the first Donna article. What's up with that? In that case, the guilty group should be begging him to take it to The Grand Jury because, trusting Milam has made it clear that there is insufficient evidence. I would agree with you that there seemed to be many failures and shortcomings that occurred prior to Milam and Waller's election, but by no means does that absolve them from responsibility to resolve an open murder case- especially one as heinous as this one was.
Nobody ever suggested they should put EVERYTHING else aside to focus solely on this case. That's a childish, irrational position for you to take. People can have multiple priorities and multi-tasking is a required trait for people in positions of authoirity.
You can sit there feeling helpless about what you don't have, fretting over the prospect of failure or you can roll up your sleeves and work passionately to try to fill in the blanks. That's not unique to Law Inforcement, it's the key to a successful life for anybody.
I sure hope you're not one of the ones on whom this case depends. If so, the people of Lamar deserve better.

I am not young anymore... Donna was only 5 months older than me...and I am not afraid...the guilty be damned...its time for justice...he deserves to be punished and this time ...somehow someway..its gonna happen

i am a cousin of donna ..i was there ,searching potato creek for a dead body. coincedentally, this was my fourteenth birthday. i spent it wading for my cousins body ..i know in my heart of hearts that someone knows who and what happened that fateful day..i realize you may feel bad for not reporting this earlier,, but you can be understood and forgiven !!!! just make an annoymous tip, its time we put this to rest!!!! every b-day i have, i think of a cousin i hardly knew, and i wonder who, why ,for what reason ..someone can help me and my entire family..please, if you know the path law-enforcement needs to be on,, help us !!!i have alot of bad things in my life to deal with ,,YOU can help me deal with this ,,,, yes YOU !!!!

You know, I really feel that way also. You cannot help but wonder how many conversations have gone on in 26 long years. Somebody, somewhere is sick of carrying that load of guilt. Someone is hoping they will all die...and they will eventually. But then.....you always have to wonder "Where is that little notebook that old whats his name used to keep????" The last words that are said by a dying man that are actually usable in court. That murderer cannot even breathe a sigh of relief when the last guilty person hits the obit column. That must be one helluva life. And these readers tell me to get a life. Whee-doggy, I am glad I do not have theirs.

First off, I'm not "blogging", and since you ask, just why are you so concerned? You are merely an outside observer, but for whatever reason, consider yourself some type of authority, or more credible than others on the subject. Truth is, "Anonymus" is the default name assigned here.
Also, I was about 7 or 8 years old when this happened, and I am in no way connected to any government agency, don't even know Milam or Waller past casual conversation in public. You trying to insinuate that anyone who speaks out against your and others rants, assumptions, speculations and deragatory remarks on this issue or about our respected elected officials is absurd. You won't intimidate me with that, and hopefully others reading this won't be either.
Yes, this case is appaling, if you don't think so, then something is wrong with you. But the truth is, it sat cold (yet "open") for decades, but recently got some press coverage, and some of you get all emotional and expect everyone to jump as commanded because you say so. Gonna picket and protest. Well, it just doesn't work like that, but if you did, you woulld get some more attention.

The officials know what probably will and will not result in a conviction. Also, they are held by judicial canons to practice under certian standards. Obviously, the lack of evidence in this case doesn't merit a grand jury inquiry at this time. I trust they are working on it, and will do what they need to when they get what they need. If they don't, it is unfortunate, but thats how the legal system works. Can't rightly prosecute someone with unsupporting evidence.

This is just another testament to the pain inflicted on our families lives by this monster.I am so sorry you have had to live with this memory on your birthdays all these years. THE GRAND JURY TELLS THE DA WHAT IS ENOUGH EVIDENCE FOR TRIAL.
It can even be presented again at a later date when new evidence is presented if the grand jury no bills.
If they grand jury true bills, then the DA prepares for trial and the case information can be request through a Freedom of Information Act.
Pre-trial motions are presented and granted or denied. The DA can then choose to go forward with the case or decline prosecution. If crucial evidence is tossed out, he can decline. If new evidence comes up, he can pursue the case again at a later date.
PLEASE go and get a new Barnesville paper.....then come back on this blog and tell me one more time "about what a wonderful and competent sheriff we have here in barnesville." You will not believe how incredibly suspicious this county is looking more each day. THIS MAN IS BASICALLY trying to tell them WHO the murderer is....and they "will get back to him later." Walter, I hope you are sending all of this to a caring federal agent because the picture I am getting is the local agencies aren't taking such a brutal crime seriously.
No one will comment, detectives ignore complaints and tips. At this point is seems all they are doing is "making notes in the case file."
This case is not about Donna to these local officials. They can snake around and hide everything they can find to hide. Milam can yell "insufficient evidence" to any fool that wants to believe him. If he was so DAMN confident that their is insufficient evidence, he would take it before The Grand Jury and climb on top of the courthouse and say, "I TOLD YOU SO." Is there a deputy from another district that would volunteer to go and interview this Gentleman that has probably put his own life on the line, to assist in finding Donna's murderer? Evidently, Lamar County has more important issues that just an old murder case to worry about, huh?
If I remember correctly. Wasn't there a Pawn Shop owner on Market St. killed by blunt force to the head? Was that crime ever solved? Didn't it happen around the same time?
I do not know if you remember, NOT Shelia Tolley, but a hair from a black man was found as part of the initial case in Donna's murder. It was later explained away by this reason "Donna's body was placed into a used body bag." Now here is a gentleman that is volunteering to tell of two whites and one black man who COULD POSSIBLY BE suspect in this murder. I wonder if the hair has disappeared? I wonder if the rope has been tested for DNA? I wonder how well Milam and Waller sleep at night? This case is just full of I WONDERS, isn't it? I wish I could do magic. I would send Donna in for an interview. But I am sure they would be too busy, wouldn't they?
I bet you would be just this calm if it was your daughter, wouldn't you? Read Donna's Last Hours on page 4A, then come back and tell me the case does not DESERVE a trip to The Grand Jury...ok? If there is a person in the world that a heart like yours can love, insert her name in place of Donna's as you read about Donna's last brutal hours. Then think about the nine thousand nights that Donna's Mother tried to fall asleep, before she was blessed with death herself. Then stick your calm, cool, defense of the legal system in this case up your a$$.

I live in Pike County! A friend called and read the Barnesville Herald to me. I went and got the Pike County Journal. Where is the story about the man trying to tell what he knows?
Agreed. This happened 26 years ago and nothing has turned up. The killer is probably dead and gone by now. I'd rather law enforcement be working on present day stuff instead of wasting time and energy on something they can't do anything about. Let the GBI/FBI worked it out. Theres more important stuff happening today that they can prevent or solve.

Morgan was last seen on Mother's Day, May 13, 1984 in her hometown of Lamar County, Georgia. She was at her mother's residence during the evening hours and reportedly received a phone call at approximately 7:00 p.m. The conversation lasted 4 to 6 minutes and was related to Morgan's work in the computer center of the National Cash Register Company in Fayetteville, Georgia, where she was employed at the time. Morgan received another call at approximately 10:00 p.m. and told her mother she was going to work to solve a computer problem. Morgan's mother told authorities that her daughter changed clothes and departed the house. Morgan has never been seen again. Her mother reported her as missing the following day, May 14, 1984. Morgan's car was located in the south terminal parking lot of Atlanta Hartsfield International Airport on May 16, 1984, two days after she was last seen. The vehicle had been abandoned and there was no trace of Morgan. According to her family, she did not have any travel plans and it was unlike her character to leave home without alerting loved ones as to her whereabouts. Morgan has a young daughter as well.
Morgan's mother told investigators that her daughter had been divorced from her husband in February or March 1984. Morgan apparently told her mother she suspected she was being followed during the divorce proceedings. There has not been any activity within Morgan's financial accounts since her disappearance.
I read this article and was shocked that this guy called LCSO, they sent out an investigator and the detective rufused to wait 20 minutes for the guy to get home... no damn wonder this case has went so long unsolved. shame on LCSO and this pos gumshoe...I want to say unbelievable, but not that shocking I guess...
It leaves a big empty spot in you. You will catch yourself dialing the phone...then you remember,and cry instead. You will see a favored object of the one you loved and actually realize even to the point of WRAPPING it, that they are GONE..then you will just cry. Their birthdays come and go, Family Reunions have missing personalities, a little note they left on your door years before will become more valuable than all the money in the world. The empty spot NEVER leaves. I HATE YOU for making me cry again. Your turn will come. That empty spot can never be filled while on this Earth by anyone. It hurts real bad. Isn't that sickening. Even if a boss had called me, I would have said........YES SIR, I am here now and I see a car coming in the drive-way. BUT........They probably sit 50 yards away waiting on him to leave before driving up so they could say they responded and leave. I saw 3 Lamar County officers at Huddle House one afternoon all standing outside cars leanin on them. It was 1:00pm when i went by, came back by there at 2:15 and they were still there. Lunch break or bullsh**t break. I dont think 3 would get lunch break at same time since they have a million things to do>>>>>> and as far as the investigator having a million things to do, what major cases is Lamar county investigating? I do not usually write on these things. It really is ridiculous and very suspicious if you have watched this case from the beginning. Why has this case not been presented before a grand jury? I am starting to lean in the other direction, as well. The longer this goes on, the worse our DA and Sherriff look.
He reminds me of a Quality Control Manager of Receiving that I worked with at one point in my life. He would piddle around on piddly stuff and call unimportant meetings so that he never got anything inspected to support the production line. When we finally run completely out of parts, he would run to the "BOSS" and say, I have not had time to inspect those parts, do you want me to bypass inspection so the line can continue to run? Of coarse the "BOSS" wanted the line to run......but if a part come up which caused a problem, the QCM just said, "Oh, I had to bypass those, remember." It was stated in an earlier story that when Donna’s car was found it had been wiped clean of finger prints. It could be possible that the “dump” scene was not staged, but a staging point where the car was left by the suspects to retrieve later and dispose of. I say this because it appears that this is what happened to Helen Morgan. She was never found, but her car was found at the Atlanta Airport. It had been wiped clean of any fingerprints as well.
Helen was reported missing May 13th 1984
Donna was reported missing and found deceased July 16th 1984

Joe managed to get Donna's body exhumed. Check out this process.
Get permission from relatives and authorities. If the body is being exhumed for the purpose of a criminal investigation, you must get a warrant from a judge and have probable cause that DNA from the deceased will be useful in the investigation. This can be complicated by family members of the deceased who do not want the body exhumed and may seek an injunction trying to stop it. You should get permission from the family if you want an exhumation for reasons outside of a criminal investigation. If the family members are unwilling, you may have to sue to have the body exhumed.
Apply for the proper permits. While the laws regarding exhumation differ from state to state, there generally is an approval process that includes obtaining a permit from the state attorney general's office. This is streamlined if you are the next of kin, but can become complicated if you are not, since the family must be notified. The family can resist the order and seek to stop the exhumation through the courts.
Plan the day. Prior to having the body exhumed and possibly before applying for the permit, you must have a plan for the exhumation and subsequent reburial. The cemetery must be informed of the exhumation date, the proper machinery must be rented or contracted for to remove the dirt and lift the casket. There may need to be a local health or environmental safety official present to insure there are no health issues. I've been upfront with my support for Larry Waller. I have stated my opinions on this case as have a lot of others. Still, no one in law enforcement is addressing the issue. It does rub me the wrong way.
We, as tax payers have used a forum known to be seen by those in charge and those who vote for them to share our thoughts. It is no different that going to a town hall meeting except I get the opportunity to remain faceless.
If Waller & the GBI want to continue to make no comments, that is their choice. I will then use my free-will and form my opinion that they are not concerned with this case. That's how it works.

I do not know if Donna or Helen knew the guys in question. Given Donna's history of being a non party type person, it could be assumed that she was not associated with the likes of the folks that occupied the mobile home in question. Donna's house was located 1.5 to 2 miles from the mobile home mentioned in the print article. the dump where her car was found was located almost an equal distance between the two on the same road. I wonder if the guy who moved to Alabama or the lady who moved to MO have ever been interviewed?

I don't know if Ann Morgan knew Donna, but she was living on Hwy 18 near Piedmont Road, about 2 miles from where Donna grew up. I do not believe Ann did meth or cocaine, she was working at NCR in Peachtree City, taking night classes at Gordon Junior College. She was a very responsible person. I knew her for a long time and don't ever remember her even taking a drink. Ann was separated from her husband(maybe divorced) and there were rumors that drugs may have been an issue. Ann's mother died from cancer about 3 or 4 years ago.

As far as the hair from a black person could possibly have came from a contaminated body bag, why in the hell dont they do a dna test on it. If they come up with a hit in the data base that LIVE person would have a hard time explaining what their dna (hair) was doing in a body bag. If nothing shows up then everybody is no worse off because they are not going to dig up all the bodies that the hair could have came from. This is the year 2010 and law enforcement in other cases are surely using dna to solve other cases, why not this one? Maybe the are. I sure hope so.
They have to have a suspect named to present a case to the grand jury for possible true bill, dum dum. Maybe they don't have a suspect, or maybe they do, but the evidence isn't there for a successful prosecution. (yet) Once you start, theres really no stopping.
Getting an indictment is very easy, but conviction for murder isn't. Maybe thats why they aren't running this to the courthouse as you commanded.

Yes, Monahagn was "in charge". Ann Morgan's car was found at the Airport on Wednesday. On Monday there was a heavy rainstorm at the Airport and no other rain that week. This is important because Ann's car had been parked there prior to the rainstorm. You could tell from the mud and dirt outline around the car and also the dirt washed up against the tires that the car had been parked there prior to the rainstorm. Ann did not willingly "take off to have a good time" as Monahagn was allegedly overheard to say. Someone or somemany lured Ann out with a story about work. Some who knew her very well.

The public can do a lot by helping to put pressure on law inforcement and the DA to make this a top priority. Every time you see the sherriff or the DA- on the street, in a restaurant, at the courthouse- ask about Donna. Ask whether they've made any new advancements. Tell them that catching the killer is important to you.
Everytime you see the suspects, ask them how the case is going. Ask if they're excited about authorities getting closer to catching the person who did this. Ask them, "Won't you be happy to get closure after so many years?"
Can you imagine the pressure of having to answer these questions over and over and over again, by so many different people, every single day? The sherriff and the DA will get the message loud and clear that the voters demand this be resolved. The perpitrator(s) and his/their accomplice(s) will get the message that it's not going away and they can never, ever rest easy again.
I always wondered what kind of depraved rage would drive somebody to gouge a woman's eyes out, sodomize her with a metal object, beat her head in with a hammer and run over her with a car. If a man thought his wife was in love with another man, that would probably make him pretty angry. Could that be a motive?
I'm still puzzled why her father-in-law , if in fact, he saw her or talked to her at 2:15, would be so worried about her not returning from the dump less than two hours later. (Mike found her car at the dumspter at 4:20.) You wouldn't normally start worring that soon without some reason to do so. I still find that VERY odd.
Also, I believe Mike was a little older than 17 at the time of the crime. I'm pretty sure Mike graduated in 1983, so he would have been at least 18 at the time and I'm thinking he was closer to 19. Not that it matters, but he was legally an adult at the time.
That is not your choice, thats the way it is, just like it's not your "choice" not to be involved past "observer" or "speculator" or however you wish to phrase it. Want real involvement? Hire a private investigator to research this. But no, you'd rather ramble on and on for attention, instead of putting your money where your mouth is.
Also, this case certianally derseves recognition and support, but there are sure a lot of others in the local area that were just as bad that are unsolved that do too, why aren't y'all crying about those too?

There is nothing wrong with the citizens re-energizing the investigation. I would think the only people who would be bothered by that are the ones with something to lose. Whatever that something might be.

Remember, there are many, many more officials to blame for a supposedly botched investigation than the current Sheriff and DA. Is this case really that difficult? If I were on a jury, and had all these facts---I know what my verdict would be! With or without dna or witnesses---facts are facts. Who killed Donna?? Hasn't everyone but the DA figured that out already...

Nobody ever suggested they should put EVERYTHING else aside to focus solely on this case. That's a childish, irrational position for you to take. People can have multiple priorities and multi-tasking is a required trait for people in positions of authoirity.
You can sit there feeling helpless about what you don't have, fretting over the prospect of failure or you can roll up your sleeves and work passionately to try to fill in the blanks. That's not unique to Law Inforcement, it's the key to a successful life for anybody.

We all have our conceptions about it, and you’d be surprised at how many ways there are to look at it. So humor me as I go over some various ways we understand what blogging is. The fact that the writing takes place on a blog makes it different than other forms of writing. How do you know it’s a blog? Articles, called posts, are listed in reverse chronological order. You trying to insinuate that anyone who speaks out against your and others rants, assumptions, speculations and deragatory remarks on this issue or about our respected elected officials is absurd. Yes, this case is appaling, if you don't think so, then something is wrong with you. But the truth is, it sat cold (yet "open") for decades, but recently got some press coverage, and some of you get all emotional and expect everyone to jump as commanded because you say so. Gonna picket and protest. Well, it just doesn't work like that, but if you did, you woulld get some more attention.
I want them to find the killer also, but I want them to be dang sure they got the right person, not run and grab someone just to shut a bunch of hell raising folks up.
The officials know what probably will and will not result in a conviction. Also, they are held by judicial canons to practice under certian standards. Obviously, the lack of evidence in this case doesn't merit a grand jury inquiry at this time. I trust they are working on it, and will do what they need to when they get what they need. If they don't, it is unfortunate, but thats how the legal system works. Can't rightly prosecute someone with unsupporting evidence.

THE GRAND JURY TELLS THE DA WHAT IS ENOUGH EVIDENCE FOR TRIAL.
It can even be presented again at a later date when new evidence is presented if the grand jury no bills.
If they grand jury true bills, then the DA prepares for trial and the case information can be request through a Freedom of Information Act.
Pre-trial motions are presented and granted or denied. The DA can then choose to go forward with the case or decline prosecution. If crucial evidence is tossed out, he can decline. If new evidence comes up, he can pursue the case again at a later date.
THAT IS HOW OUR JUSTICE SYSTEM WORKS.
Go and get the new Barnesville paper. If people think Milam and the sheriff are not keeping this case closed for reasons other than Donna....they must have received a screwed up lobotomy. Is takes one sorry person not to make it a top priority to go and talk to this Gentleman. An endless loop of Elected Crimemongers...If Merrill Greathouse would have been sorry like the rest of them, he would be alive today. That is my bet!

Morgan's mother told investigators that her daughter had been divorced from her husband in February or March 1984. Morgan apparently told her mother she suspected she was being followed during the divorce proceedings. There has not been any activity within Morgan's financial accounts since her disappearance.

Get permission from relatives and authorities. If the body is being exhumed for the purpose of a criminal investigation, you must get a warrant from a judge and have probable cause that DNA from the deceased will be useful in the investigation. This can be complicated by family members of the deceased who do not want the body exhumed and may seek an injunction trying to stop it. You should get permission from the family if you want an exhumation for reasons outside of a criminal investigation. If the family members are unwilling, you may have to sue to have the body exhumed.
Apply for the proper permits. While the laws regarding exhumation differ from state to state, there generally is an approval process that includes obtaining a permit from the state attorney general's office. This is streamlined if you are the next of kin, but can become complicated if you are not, since the family must be notified. The family can resist the order and seek to stop the exhumation through the courts.
Plan the day. Prior to having the body exhumed and possibly before applying for the permit, you must have a plan for the exhumation and subsequent reburial. The cemetery must be informed of the exhumation date, the proper machinery must be rented or contracted for to remove the dirt and lift the casket. There may need to be a local health or environmental safety official present to insure there are no health issues. There also needs to be an approved location for the body, such as a laboratory or medical examiner's office. Following DNA extraction, the process must be repeated for reburial.
Extract the DNA. Once the body has been removed and sent to the laboratory, scientists will try to extract DNA from the body. This can be difficult depending on how long the body has been buried and its overall condition.
THEN he managed to get The Vidocq Society to evaluate the evidence. That is no menial task.
