How hard is this case to prove? Who signed off on the pay increase? From whose computer was the transaction processed? Someone obviously had enough evidence to terminate her employment. Barnesville is only as strong as it's weakest link and to-date that is Richard Milam. What a loser! The only thing that we, as a town, can gain from this is that the weakling plans not to seek office next term. With his, obviously weak decisions and PLEA deals, surely he would not want to see how much disrespect he has earned in these pitiful last two years.
I truly do not know how you sleep at night, Milam. The deputies round them up and you set them free. You are truly a pitiful excuse for a DA. Are you insane? It has really reached that point.
She has no gain to spilling the beans now. She most likely done that behind closed doors. She will either be rehired with her stolen salary intact or sue the county. Us taxpayers will pay either way.
You need to understand something--there is a very real possibility that Gretchen was given the raise by her supervisor or someone else higher up, but that no paper trail was created. Until that came out, there was nothing else that could be done, but to let her go. If that is the case, she was wrong in not creating the paper trail, it was sloppy record keeping ( and I am sure this happens a lot in this county) but she did not steal from the county. Obviously the grand jury felt this was the case since they recommended that she be rehired or at the very least her unemployment authorized.
Just two more years, by then you will be residing on Milam Street in Richardville. He has enough payoff money to purchase Barnesville. He had that much before his Cha-Ching transactions today.
Just because a grand jury "No billed" this case, doesn't mean it can't be attempted again. I believe the DA can present it again two more times for indictment, and he should.
Did it ever occur to anyone that perhaps she is innocent? Jay and the Board, and their predecessors could be the ones who need investigating for all their covert dealings. Still trying to run Lamar County like it was the 1950's. I highly doubt that the Grand Jury, made up of regular citizens in this county, would have no billed a case that had sufficient evidence to indict. Obviously, the Board of Commissioners couldn't produce the evidence. Perhaps none existed.
I do not know where the truth lies, I do know our county and city are in a hell of a mess, we are building a park under the assumption the SPLOST will pass, we're paying fire and ambulance fees which no one can fully explain, our county is broke and many tax payers are seeing their hard earned money being mishandled and thrown in a rat hole...the attorney general and the GBI need to do an audit..and where is our county auditor in all this???
Stil trying to run this county like it was the 1950's! Come on IF we were in the 50's the taxpayers would not be supporting all these ppl. I find it really interesting that the grand jury not only refused to indict her, but recommended she get her job back. That really makes it seem like Patterson or the some of the commissioners were definitely aware of the raise

During a fire fee meeting last week, commissioners called a closed session to discuss personnel and litigation. Asked about the outcome of the meeting, county manager Wayne Patterson said he could make no comment on what occurred in the session.
“I can tell you a restitution plan has not been received in our office,” Patterson said. Ellerby had until Sept. 3, to arrange repayment of some $8,000 in unearned income that resulted from her unauthorized raise. The overpayments date back to February.

Thanks Sheila. I thought I remembered reading where she had admitted to giving herself the raise and her plan to pay restitution. Not only should she have been found guilty, but everybody else who was involved too. This STINKS........
I would like to know the racial makeup of the grand jury. But from what I understand , the grand jury is totally private. Not even an open records request can be submitted. I understand this is the same grand jury that has been around for a while.
It had nothing to do with Sheriff Waller, dum dum. At least Wallers case was sound enough to get an indictment the first time around. I can't comment on the DA, but it is not the Sheriffs fault here. I'm sure the grand jury played a role in it too, don'tcha think?
I know you are right, but I cannot quit laughing. I cannot get the hilarious picture out of my mind of seeing Richard Milan go out of his way to actually take a case to trial.
That would be a United States Government entitlement program run amuck, NOT a locally created problem. I'm sure the commissioners were sitting around patting themselves on the back for a job well done when Gretchen was fired and her face plastered all over the paper and labeled a thief. The problem is they didn't have the evidence to back up their claims. In 1950 she would have been railroaded and they were probably expecting that to happen today. This was a new grand jury with varied and intelligent people on it. Someone just needs to accept that there was not enough evidence to indict! Did that mean she was innocent? Not really... Does it mean that someone else is guilty of a cover-up? Maybe... Someone also ordered an audit!
Just because someone wasn't thorough in their documentation, that doesn't make that failure a crime. Why are you always trying to make someone into a criminal? Sometimes innocent mistakes do happen... even her in Lamar County.
Evidence presented to the Grand Jury and their deliberations are secret, but the names of the people who are called to serve are published in this very newspaper (at least the print edition) every time the Grand Jury is called. While some people do get called more than once in their lives, there is actually a pool of several hundred names from which grand jurors are randomly drawn (by computer).
Was 8000.00 not enough for her greedy hands? I guess if you are office manager in Lamar county its o.k. to steal 8000.00 of taxpayers money. Bottom line any one with common sense and honesty knows they are not allowed that sizeable salary increase. It is all about getting caught. With her position she figured it would never be found out. Maybe they should have fired the county administrator and her. I do hope she sues, because there is alot of evidence the grand jury did not ask to look at and in the end after all of the witnesses are brought in to testify, along with the evidence I believe she will be sent packing. If there is anything I can't stand is a thief. She can never be trusted in that position again or any position that is involved with payroll checks or money.

Before this lady would receive this public humiliation, she would have named her accomplice. You may be right. Let me think a second. Based on facts:
Mrs. Ellerby was asked to establish a payback plan for the stolen money in the amount of $8000.
She is most likely a salaried employee. Probably paid twice a month. It doesn't matter either way. The frequency and amounts after calculation will total approximately $8000.
So, assuming that she would be asked to pay back $8000, that would be the increase only "accepted" by Mrs. Ellerby. Because she was not terminated until $8ooo was taken illegally.
Therefore her check in the original amount would not have been questioned.
Therefore, she accepted and cashed 38 checks that were overstated by $210. Or less checks at a larger amount. Or one check overstated by $8000. WHY?
What would an honest person have done when they seen that their check was incorrect? They would go to "someone" and report the error. I would. Would you? Honesty in the workplace. Anything less is unacceptable by taxpayers.
Something is wrong here folks. Don't be swindled by a cover up. If by some miracle, Mrs. Ellerby did take the money unknowingly, someone else needs to be fired. A computer transaction or a document triggered the pay increase.
Taxpaying citizens deserve to know all the facts and we must ask these questions of the commissioners.
When did Mrs. Ellerby first receive the inflated amount in her check? Who keyed the transaction? Was it approved? If so, who approved it? How many checks were cashed that were overstated? Who noticed and reported the fraudulent increase? Was this noticed due to Walter's published reports of the salary of county employees? Were all other employees checks verified to assure tax payers that this is an isolated incident? Who verified this? Only an established legal accounting firm can make this verification. What was the name of the firm? Why was this case significant enough to pursue in court but negligible enough to be cleared by the Grand Jury?
You are the taxpayers, this is your money.
Something very underhanded happened in this case. It can be tracked. It should be tracked.
Someone said in a blog that the county should be audited. That is an intelligent person.
DEMAND IT. You may get a tax refund. The numbers are open records. More than Mrs. Ellerby are guilty here. Nothing else explains the lack of a TRUE BILL, nothing.
If she does not resume her previous position, ask yourself, How much more of my tax money did I sacrifice to pay for the COVER-UP?
Do not ask Mrs. Ellerby. You will not get true facts. She has definitely signed a confidentiality agreement.
How much does the county owe their citizens of their abused tax money?

There you go running off at the mouth again without getting the facts straight. The raise in question was $5,000 a year, raising her from $40,000 to $45,000.
But it does not show WHO served on this actual case. Word on the street is two of her relatives were on this Grand Jury. If so, number 1 reason why this should be looked at by the Attorney General Second, there were strong words exchanged by the white jurors and the black jurors and the black jurors out numbered so this case was no billed. If so, it appears a case of reverse discrimination has occurred here! Maybe this would explain why Mr. Worthy was no billed after a "HISTORIC" second trip to the Grand Jury!!

There is often relatives of the accused on the grand jury. What is supposed to happen is the DA asks if anyone is related to the accused and those jurors step out of the room while that case is presented and voted on by grand jury. There are 23 jurors and only 16 (if I remember right) need to be in jury room to present the case. 12 affirmative votes are needed for a true bill. If less than 12, the case is no billed. The grand jury does not vote to no bill, a no bill is automatic if vote fails to true bill.
easy to answer sheriff and his investigators are not going to do anything to mess up there little house or the county comm chairman's reputation and as far as the gbi it's the same girl who has been stuck there butt for the last few years. or could be they are not smart enough to follow the paper trail

When did Mrs. Ellerby first receive the inflated amount in her check? Who keyed the transaction? Was it approved? If so, who approved it? How many checks were cashed that were overstated? Who noticed and reported the fraudulent increase? Was this noticed due to Walter's published reports of the salary of county employees? Were all other employees checks verified to assure tax payers that this is an isolated incident? Who verified this? Only an established legal accounting firm can make this verification. What was the name of the firm? Why was this case significant enough to pursue in court but negligible enough to be cleared by the Grand Jury?
The Dollar Fairy gave Gretchen a $12,000 increase per year.
Just her increase was only $3,000 less than you make all year.

Gretchen Ellerby, the former Lamar County commission office manager, payroll clerk and human resources director, has yet to make restitution for her alleged $5,000 a year unapproved pay raise.
During a fire fee meeting last week, commissioners called a closed session to discuss personnel and litigation. Asked about the outcome of the meeting, county manager Wayne Patterson said he could make no comment on what occurred in the session.
“I can tell you a restitution plan has not been received in our office,” Patterson said. Ellerby had until Sept. 3, to arrange repayment of some $8,000 in unearned income that resulted from her unauthorized raise. The overpayments date back to February.

"At the meeting last night, Jay insisted that Gretchen was guilty and Patterson was being terminated so that the board could "take another direction"(whatever that means) and have more input on the day to day operations."
