Assault charges leveled against him here in Lamar County apparently will not impact the career of Morehouse College police chief Vernon Worthy in the short term.
The college issued a two-sentence statement on the matter last week after repeated requests for comment from The Herald-Gazette.
"Chief Vernon Worthy is a long standing and loyal employee of Morehouse College. The incident that occurred in Lamar County happened on his personal time and outside the scope of his employment," Toni O’Neal Mosley said in a prepared statement. Mosley is Morehouse’s director of public relations.
Worthy was bound over to superior court here November 24 on charges of aggravated assault, false imprisonment and pointing a gun at another. The charges were brought by local resident Nathaniel Rooks.
Rooks claims he was hunting on November 11 when he encountered Worthy who pulled a gun on him, forced him to lie face down in a field and accused him of trespassing. An investigation by DNR ranger Keith Page determined Worthy was the one who was trespassing and Rooks subsequently sought warrants.
The case will likely go to the Lamar County grand jury to be impaneled in March, 2009, according to district attorney Richard Milam.
"We have ordered a copy of the tape recording of the hearing in magistrate court and will have it transcribed when received. Our plan is to give a copy of the transcription to the sheriff’s office and request an investigation and reports. Then the case will be presented to the grand jury. With the transition in the sheriff’s department, I cannot say how long it will take us to get an investigative file," Milam reported.
Well, by golly, you are absolutely right Larry. Joe was in the position of sheriff when this case had to be brought to trial by Mr. Rooks. Probably an error in judgement. It may have even cost him the last election. But, if he were to run again for sheriff, your blunders would get him re-elected. Mr. Rooks would probably even vote for him after the past term of events. I truly apologize, however, for using your name in this PARTICULAR case.
Now, will you explain to me why this true bill has been ignored since 2008? You took office on January 1, 2009. Why has it been brought back for a second look-see? Superior Court Judge Tommy Wilson today denied a motion by the legal team representing Morehouse College police chief Vernon Worthy that could have sent his assault case back to the grand jury.
He was indicted in September 2009 on false imprisonment, aggravated assault and pointing a pistol at another. Worthy is accused of pointing the pistol at Nathaniel Rooks and threatening him on Nov. 11, 2008, while hunting. Rooks testified Worthy ordered him to lie face down on the grass and forced him at gunpoint to roll away from his rifle and toss away his cell phone.
"He told me 'I will blow your (expletive deleted) brains out if you try anything'," Rooks said. He added he feared for his life and started praying aloud only to hear Worthy say, "God is the only (expletive deleted) who can help you right now."
Worthy's attorney Pandora Palmer argued the grand jury was invalid because bailiff George Barrett was a county officer while serving as a jury commissioner. They called into question his actions in the July 2006 primary election that resulted in him, Dr. E.H. Harris and former probate court judge Frank Fletcher signing an administrative consent order regarding irregularities in the way they assisted some absentee voters.
Judge Wilson sided with the district attorney's office, which noted the term "county officer" refers to constitutional officers and citizens can only be disqualified if they have been convicted of a felony.
Barrett and Dr. Harris, both called to the stand as witnesses, have never been convicted of any crime.
In addition to the supplemental plea abatement argument, a pretrial hearing was continued due to Worthy's supreme court appeal of earlier arguments in the case that were denied.

Census data puts blacks at 28.93% of the population but the jury pool was 35.36% black."
My, my, my.....over and above the required number of black jurors, and he was still indicted. It seems to me that the only change would have been the evidence presented OR some unWORTHY person may have "had conversations" with a few jury members.

If it was a different grand jury, you can bet that the evidence changed. If it was the same grand jury..........what changed? Surely not the jurors opinion...for that means that they voted wrong the first time. No juror would be that stupid after taking an oath.

It so amazes me that every person who defends our current administration is always ANONYMOUS.

Why was the first opinion of the Grand Jury not honored?
The answer is in one of the old newspapers if you care to read it. Because Worthy(less) denied some real facts, they were deleted as evidence. In other words, they have assumed that Mr. Rooks was lying. This is the sorriest, most humiliating act that I have ever seen, even for our town. Mr. Rooks would not have hired a lawyer if he had the need to lie. How stupid are you defenders of Richard Milam? I guess he is Barnesville's version of the anti-christ.
You can appreciate the crooked ways this case was handled if you want to. I am sure you are among those that does not have a need to worry anyway.
One more thing while we are having this nice conversation. It has been highly pointed out that this case was not properly pursued by Joe Buice when he had three more months left in office, I ask you this, What good would it have done?
If Larry Waller would tell the truth, he would not have pursued it either. Birds of a feather...............

The Herald-Gazette has confirmed Morehouse College police chief Vernon Worthy was indicted today by the Lamar County grand jury on charges of false imprisonment, aggravated assault and pointing a gun at another. The charges arose out of a confrontation in which Worthy allegedly pulled a gun on a local man whom he claimed was trespassing.
Testimony at a magistrate court hearing last year, however, indicated Worthy was the trespasser.
The incident occurred Nov. 11, 2008 when local resident Nathaniel Rooks and Worthy crossed paths on land Rooks claimed he had permission to hunt.
At the Nov. 24 preliminary hearing, Rooks testified he was in a deer stand when he saw someone enter the field. He said he climbed down from his stand, took off a camouflage mask, slung his deer rifle over his shoulder and approached the man he later learned was Worthy.
Worthy then pulled a pistol on Rooks and ordered him to lie face down on the grass. He also forced Rooks at gunpoint to roll away from his rifle and toss away his cell phone, Rooks testified.
"He told me 'I will blow your (expletive deleted) brains out if you try anything'," Rooks said. He added that he feared for his life and started praying aloud only to hear Worthy say, "God is the only (expletive deleted) who can help you right now".

Page took serious issue with Worthy pulling a weapon on Rooks.
"There was no reason for a gun to be pointed at Rooks. I've approached hundreds of deer hunters and have never had to pull my sidearm," Page testified.
Law enforcement declined to charge Worthy so Rooks brought the charges personally. Worthy was bound over to superior court on the charges for which he was indicted today. Additional charges of terroristic threats and acts, kidnapping and impersonating a police officer were dropped at the preliminary hearing.

1. I take my apology back Mr. Waller, it turns out that Mr. Buice made an absolutely prophetic decision. He knew that the case would not be pursued by the Grand Jury.
2. If a person approaches you, even in an unthreatening manner, it is perfectly legal for you to pull your Big Old Gun, point it at them, make them lie on the ground, move away from (previously shouldered) rifle and cell phone and tell them that "God is the only F#*#*#* thing that can save you now", as you are praying to live.

A "No Bill" means that the case will not be referred for a criminal trial - - at least by the Grand Jury. The D.A. could, however, gather further evidence and file a Criminal Complaint and move the case directly to trial without a Grand Jury indictment, provided that the Statute of Limitations is in check.
