Frenchie Fambro was indicted by the September term Lamar County grand jury on a single count of voluntary manslaughter Tuesday, according to district attorney Richard Milam who took the case to the panel as a special presentment.

This is the way it is suppose to work, probable cause for the warrant, then the grand jury decides if there is enough evidence to proceed with murder or voluntary manslaughter, or no bill. Now it goes to trial and the trial jury decides guilty or not (self defense) Not the Mag Judge who issued the warrant in the first place.

What a stupid judge!!!! How do you decide that there are charges, have him arrested, then decide there is no charge and let him go? HOW? Then it is presented to the Jury (which is how it is suppose to work) and they true bill? Sooooo there is obviously evidence and the right people did their job! Now it will be up to Milam to present and the jury to decide what the outcome will be.

I love how people in this town know it all and love to finger point. Next there will be some wild conspirecy theory. All from the same people who think you can get a finger print off of a rock...lol

What judge signed the origional warrant for Frencies arrest? If there was no evidence or cause for arrest then why was he arrested? Somebody help me out here...this is not making a lot of sense. The police must have had evidence because of the Grand Juries conclusion. Now what? Do the police have to arrest him again because the judge let he go prematurly or will he get to stay out of jail until the trial? I know law enforcement must be sick of the revolving door at the courthouse.

It's about time the grand jury decided to convict a criminal for manslaughter. This was not self defense or else he would not have chased him down and shot him again. This was rage and it should be punished. JUSTICE IS NOT BLIND!

Yep...have to start with the highest charge and work down. By the time this is over he may be charged with just aggravated assult. Im guessing this is going to be a hard case for the jury. Hope none of them have been reading all of the crap on this blog. You have family and friends for both men on here talking about stuff they have no idea if it is correct or not. Plus, all of the arm chair lawyers already deciding who has screwed the case up, who hasnt done what, who jumped the gun and a judge who allowed the arrest of a man and then after some time turned aroung and let him go, prior to grand juriors hearing the evidence....what the hell??? Maybe after all of this is over, Walter will have all of the facts straight and can print it so you know it alls can pick it apart.

The grand jury cannot nor did they convict anyone of anything. They merely heard the evidence as presented by the district attorney and indicted Mr. Fambro on the proper charge in this case. Now the case goes to a jury trial in open court. Given the circumstances, if the DA doesn't botch this, I would bet the jury convicts and the judge sentences the maximum of 20 years behind bars.

Mr. Fambro was obviously arrested on what the investigators presented to the magistrate as their evidence at the time. The defendant's counsel, by law, has the right to request a pre-judicial hearing to present their evidence if they feel their client is wrongly accused. Evidently this is what happened and the magistrate felt that the defendant's attorney had a stronger case against a murder charge then the police had for one. He then decided to dismiss the murder warrant that he originally signed opening the door for the district attorney's office to seek an indictment for the proper charge of voluntary manslaughter. The judicial process is working correctly so far in this case.

Apparently the DA and the Grand Jury aren't aware that Georgia is a "Stand Your Ground" state.

Google will fill you in on why this gentleman will walk. And should.

We need a new DA and Sheriff in this county, badly.

He would have walked for firing the first shot in self defense but he fired more while the victim was down therefore voluntary manslaughter. He will be convicted and sentenced to the max term of 20 years.

Maybe you should go back and read that code section again. It says for habitation. The law does not look at your car as your home. So that law does not apply to this case.

So is Mr. Fambro in jail at this time? When an indictment comes down, is the defendant re-jailed and then can post bond again?

Bzzt... Wrong. You are referring to the Castle Doctrine. No duty to retreat is the stand your ground law I am speaking of.

..and there is no "shot only once" clause. You continue to fire until the threat is no longer functional. When in doubt, empty the magazine.

Virgil Brown should get this case, but I doubt this guy can afford the $8000 retainer that would take.

What does the Sheriff have to do with this case? It happened in the city, the city police department handled the investigation, and incorrectly charged Frenchie to begin with. We need a new police chief, and have for a long time now.

They have to start with the highest charge in the case and then let the jury decide what to charge him with......that is what has happened. It has been handeled correctly. What dont make sense is that the judge jumped the gun and released him, knowing that the case was going to be presented to the Grand Jury.So now he has to be arrested and processed again. For those of you starting the blame game, learn about what if going on first.

There was no bond set for the original murder charges. When Frenchie was released from jail, he was released because the charges were dismissed. Now that he has been charged with the lesser offense of manslaughter, he has been jailed on those charges. I would expect bond to be set on the manslaughter charge.

The "Stand Your Ground" law may apply to the first shot he fired but when he fired the other shots, the "Stand Your Ground" law does not apply because the threat was no longer there.

According to ya'll everyone is innocent and nobody ever commits crime in Barnesville. lol. Really? So that man dropped dead of his own accord...wait...no he must have shot himself repeated. Good grief people. It's not about race, it's about justice. If you shoot someone you deserve to go to jail. Just like if you hit someone with your car and they die (regardless of if its an accident or not) you serve time.

How can #21 say if you shoot someone you deserve to go to jail? What if you walk in your home and your wife or daughter is being raped? I personally feel that if i'm sitting in my car and you put your hand's on me you are shot! I come home and catch someone inside my home, they are shot! I don't bother anybody and i'm not going to let anybody bother me or anything i have. I pray in Frenchie's trial that 1 of 12 have enough common sense and nerve to stand up for what is right.
